Agreement

These Terms of Use govern access to and use of 5K AI, an AI-assisted growth operations platform operated by Conklin Media LLC d/b/a 5K.co.

By accessing the platform, creating an account, accepting an invite, using Google sign-in, or connecting a third-party service, you agree to these terms on behalf of yourself and, if applicable, the organization you represent.

The platform is currently intended for 5K internal personnel and invited collaborators. 5K may later invite clients to access client-specific information and workflows under these terms or additional written agreements.

Use Of The Platform

You may use 5K AI only for lawful business purposes and in accordance with these terms, applicable laws, third-party service terms, and the permissions granted by 5K or your organization.

You are responsible for the accuracy, legality, and authorization of content, client records, campaign data, files, credentials, and connected accounts you submit to or use with the platform.

You may not

• Bypass security controls or access data you are not authorized to access.
• Interfere with the service or scrape, overload, or stress the platform.
• Reverse engineer protected parts of the platform or introduce malicious code.
• Use the platform to violate another party's rights.

Client users

Client users may access only the workspace areas, client records, reports, recommendations, approvals, and connected information made available to them by 5K or the applicable organization administrator.

Accounts And Security

• You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
• Notify us promptly if you believe your account, organization workspace, OAuth connection, or credentials have been compromised.
• We may suspend or limit access when we believe it is needed to protect users, clients, connected accounts, data, the platform, or 5K.

Connected Services

The platform may allow authorized users to connect third-party services, including Google sign-in, Google Ads, Supabase-backed authentication, analytics, finance, or other business systems.

• By connecting a service, you authorize 5K AI to access, process, and use information from that service to provide the requested product functionality. Your use of third-party services remains subject to their own terms and policies.
• You are responsible for ensuring that you have the right to connect each account and to authorize the scopes requested.
• You may revoke Google access through your Google Account permissions or through product controls where available. Revoking access may limit or disable related platform features.

AI-Assisted Recommendations

5K AI may generate recommendations, summaries, drafts, analyses, or operational suggestions. These outputs are decision support, not a substitute for qualified human judgment.

You are responsible for reviewing outputs before relying on them, sharing them externally, approving actions, or using them to make business decisions.

Confidentiality And Client Data

The platform may contain confidential 5K, client, prospect, campaign, strategy, finance, HR, or operational information. You may use that information only for authorized business purposes inside the scope of your role.

You may not export, disclose, copy, or use another organization or client's information except as authorized by 5K, the applicable organization, or a written agreement.

Client data remains subject to applicable client agreements and permissions. These terms do not grant client users access to information outside their authorized scope.

Intellectual Property

The platform, software, workflows, interface, design, brand assets, documentation, and underlying technology are owned by 5K or its licensors and are protected by applicable intellectual property laws.

You or your organization retain ownership of content and business data submitted to the platform, subject to the rights granted to 5K to host, process, secure, analyze, transform, and display that content to provide and improve user-facing platform functionality.

Availability And Changes

5K AI is actively evolving. We may add, modify, suspend, or remove features as the product develops and as integrations, security requirements, or business needs change.

We work to provide a reliable service, but we do not guarantee uninterrupted availability or that every recommendation, integration, import, or analysis will be error-free.

Disclaimers And Limitation Of Liability

The platform is provided on an as-is and as-available basis to the maximum extent permitted by law.

To the maximum extent permitted by law, 5K will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from use of the platform.

Termination

You may stop using the platform at any time. 5K may suspend or terminate access if you violate these terms, if an invite or client relationship ends, if required by law, or if continued access creates a security, legal, operational, or client-confidentiality risk.

Some records may be retained after termination where needed for legal, security, billing, audit, dispute, backup, or legitimate business purposes.

Changes To These Terms

We may update these Terms of Use as the platform, integrations, client access model, or legal requirements change.

The updated terms will apply when posted or when otherwise communicated, subject to any additional written agreement that applies to your organization.
